Welcome to Auckland Climbing Gym. These terms explain the practical rules that help us run a safe, fair and reliable climbing facility. They apply when you enter the gym, climb, purchase something, hold a membership, use our website or submit a form.
1. Safe participation
1.1 Climbing risks
Climbing and bouldering involve real risks, including falls, awkward landings, collisions, loose or damaged holds, overexertion and aggravation of a medical condition. Injuries can be serious and may include permanent disability or death. ACG manages risks as part of operating the facility, but no climbing environment can be completely free from risk.
1.2 What we ask of you
Please complete ACG’s safety process, follow staff instructions and signs, use the facility and equipment as intended, keep clear of fall zones, climb within your ability and take reasonable care of yourself and the people around you. Do not climb while affected by alcohol, drugs, illness, fatigue or anything else that makes climbing unsafe.
1.3 Participants under 18
A parent or legal guardian must complete the required safety process for anyone under 18 and make sure they understand and follow the rules. Children must be supervised to the level required by ACG.
2. Entry and the facility
2.1 Rules and instructions
Current staff instructions, signs, closures and facility rules apply while you are at ACG. We may update reasonable safety and operating rules when needed.
2.2 Changes and temporary closures
Routes, holds, equipment, areas, hours, classes and events may change for safety, maintenance or operational reasons. A reasonable temporary change or closure does not automatically create a refund or compensation entitlement.
2.3 Refusing or ending access
ACG may refuse entry, stop someone climbing, suspend access or ask a person to leave when reasonably necessary for safety, misconduct, disruption, non-payment, misuse of the facility or a breach of these terms or our rules.
3. Responsibility when something goes wrong
3.1 Climbing and personal property
ACG is not responsible for injury, loss or damage caused by the ordinary risks of climbing, failure to follow a rule or instruction, misuse of the facility, a participant’s impairment or undisclosed safety information, another visitor, or circumstances outside ACG’s reasonable control. This does not apply where ACG is legally responsible.
Please keep your belongings secure. ACG is not responsible for loss, theft or damage that it did not cause and could not reasonably prevent.
3.2 Your conduct
A person is responsible for loss or claims caused by their deliberate, reckless, unlawful or careless conduct, misuse of the facility, or serious breach of these terms.
3.3 Rights protected by law
Nothing in these terms removes a right, guarantee, duty or responsibility that the law says cannot be removed. If any part of these terms is invalid or unenforceable, the rest continues to apply.
4. Memberships, payments and purchases
4.1 Prices and plan details
The price, billing method, minimum term, renewal method and included benefits are those shown or accepted for the relevant entry, membership, product or event. Prices are in New Zealand dollars and include GST where applicable unless stated otherwise.
4.2 Recurring payments
If recurring payment is selected, the customer authorises the agreed charges until a valid cancellation takes effect under the accepted plan.
4.3 Pauses, cancellations and change of mind
Pauses, early cancellations, hardship arrangements, credits and change-of-mind refunds are available only when included in the accepted plan, required by law or approved by ACG for that particular case. A one-off approval does not create an ongoing entitlement.
4.4 Faulty goods or services
ACG does not have to accept a return merely because someone changes their mind. If a product or service does not meet a legal consumer guarantee, ACG will provide the remedy the law requires. Damage caused by misuse, alteration, abnormal use or failure to follow instructions is not treated as an ACG product failure.
Where goods or services are acquired in trade and the legal requirements for contracting out are satisfied, the parties agree that the Consumer Guarantees Act 1993 does not apply.
5. Personal information and website use
5.1 Information we collect and use
ACG may collect information reasonably needed for entry, safety, memberships, purchases, enquiries, events, recruitment, employment, website operation, legal compliance and business administration. This can include identity and contact details, date of birth, emergency and safety information, orders, payment records, membership activity, application or employment information and communications.
5.2 Use and sharing
We may use, retain or share relevant information for the reason it was collected, a related business purpose, safety, administration, preventing misuse, enforcing agreements, legal compliance, insurance or claims. Recipients may include ACG personnel, service providers, payment and delivery providers, professional advisers, insurers, emergency services, regulators or another person where authorised by law.
5.3 Retention and security
ACG keeps personal information while it is reasonably needed for a lawful purpose. We use safeguards that are reasonable for the circumstances, although no storage or transmission method can be guaranteed completely secure. Privacy, access or correction requests can be made through our Contact Us page.
5.4 Cookies and communications
The website may use cookies and similar tools for security, forms, accounts, shopping, website operation, analytics and communications. Blocking cookies may stop parts of the site working correctly. Operational messages may be sent about an enquiry, entry, order, membership, application or employment.
6. Photography and general terms
6.1 Photography and recording
Photography or recording may occur for security, safety, training, events, operations or promotion. We will obtain consent when the law requires it. If you have a concern about being photographed or recorded, please speak with staff. Visitors must not record another person in a way that is unlawful, unsafe, intrusive or contrary to a staff instruction.
6.2 Updates
ACG may update these public terms from time to time. Changes apply from publication or another stated date and do not remove rights already created under an existing agreement.
